Unemployment Compensation

Rhode Island Unemployment Claim Attorneys

Unemployment compensation is designed to help people who lose their jobs through no fault of their own. In Rhode Island, your unemployment claim can be denied if your employer says that the termination was your fault or that you quit voluntarily. A skilled unemployment claim attorney can help you appeal a denial of your unemployment benefits.

Our attorneys have been handling unemployment claims since 1994 and our case results have helped to form the law in Rhode Island. Contact our Providence law office as soon as possible to discuss your case.

In Rhode Island, your employer has to prove that you committed willful misconduct or violated a company policy or procedure that had been enforced uniformly before your unemployment claim can be denied. For example, if your employer fired you for missing work on three consecutive days, you cannot be denied unemployment benefits if the employer did not enforce that policy uniformly. If you quit your job, the burden of proof is on you to prove that you had a good reason to quit, such as sexual harassment or illegal employment discrimination.

You Have a Right to Appeal a Denial of Unemployment Insurance Benefits

Whenever the Rhode Island Department of Labor and Training receives two versions of how you came to lose your job, your unemployment insurance claim will be denied. You have a right to appeal this decision and to have a lawyer represent you at the hearing. However, the time to appeal a denial is limited, so you must act quickly.

Depending on the amount of unemployment benefits you are owed, we may be able to handle your case on a contingency fee basis for 15 percent of the benefits you are owed. Our attorney fee would be paid from a State fund and would not reduce the amount of benefits you are owed. If you aren't owed enough benefits to cover our fee, we can quote you a flat rate.

Your rights are our number one priority. So please do not hesitate to contact an unemployment lawyer at Robinson & Clapham to schedule a free initial consultation in our Providence or Wakefield, Rhode Island law offices.
