Staffing company for employment commission sued

The United States Equal Employment Opportunity Commission (EEOC) has filed an age discrimination lawsuit against its own staffing company, Diverse Lynx. The company is based in Princeton, New Jersey, and operates as an IT staffing firm. The EEOC filed the suit because it claims the firm did not recommend an older applicant for a job because "age will matter."

According to the lawsuit filed by the EEOC, the staffing firm contacted an applicant not long after learning his date of birth, telling him he would not be referred for the job. The lawsuit states that the staffing firm sent an email to the applicant that said he was "born in 1945" and that "age will matter."

Employment discrimination based on age is illegal based on the Age Discrimination in Employment Act (ADEA). The act also includes age discrimination that comes from referrals of staffing companies. The lawsuit was filed by the EEOC in U.S. District Court for the District of New Jersey. The EEOC first tried to reach a settlement prior to litigation using its conciliation process.

"Federal laws plainly prohibit employment agencies and staffing firms from engaging in age discrimination," said the EEOC New York District director. "The firm told the man, 'age will matter.' Actually, the only things that matter are abilities and qualifications, and the EEOC is here to help make sure that's the way it is in American workplaces."

The New York District office of the EEOC is responsible for handling discrimination charges, the conduct of agency litigation and administrative enforcement in Rhode Island and seven other jurisdictions.
